MDVIP Privacy Policy

This Privacy Notice ("Privacy Notice"), describes what information MDVIP, LLC ("MDVIP", "we", "us" or "our") collects from or about you, including how we collect, use, and disclose that information, and what choices you may have regarding your information.
1. APPLICABILITY
This Privacy Notice applies to information we collect when you interact with us, including through our website, application, social media, or other online offering (the "Website").
MDVIP contracts with healthcare providers to provide a personalized healthcare experience to their patients. MDVIP acts as a business associate when healthcare providers engage us for these services. When we process information on behalf of a healthcare provider in the course of these services, our processing is governed by HIPAA (or other applicable law regulating the handling of individually identifiable health information) and our agreement with the healthcare provider, and this Privacy Notice does not apply to that information. If you have any questions about how information is processed in those circumstances, please refer to your healthcare provider's notice of privacy practices or contact them directly.
Please note that this Privacy Notice does not apply to non-MDVIP websites or services that state they are offered under a different privacy policy. Please review the privacy policies on those websites and services directly to understand their privacy practices.
2. INFORMATION THAT WE COLLECT
Depending on your interaction with MDVIP, we may collect personal information as follows:
Directly from you, when you provide information to us or interact with us:
- Contact information, including your name, telephone number, email address, postal address (or in some cases, just your city or zip code), and any other information you choose to include when you communicate with us.
- Demographic information, including your date of birth and sex.
If you make a purchase from us, we work with a third-party payment processor to process your payment information.
Automatically from you, including device information and information about how you utilize our Website, as described in Section 6.
From other sources, including third-party data enrichment providers, to better understand our consumers and improve our services. These third-party providers provide scores, predictions, or other data points about your interests and preferences in addition to demographic information, such as household composition and geographic location.
3. HOW WE USE THE INFORMATION WE COLLECT
MDVIP may use personal information we collect to:
- Fulfill or meet the reason for which the information is provided. For example, to provide the services you request, respond to your questions or communications, and provide troubleshooting and other support.
- Publish content on the Website. For example, with your consent, we may publish testimonials, reviews or comments you provide.
- Personalize your Website experience and to deliver content and service offerings relevant to your interests.
- Monitor and analyze trends, usage, and activities in connection with our Website.
- Target advertisements to you on third-party platforms and websites (for more information and to opt out, see the Targeted Advertising and Analytics section below).
- Help maintain the safety, security, and integrity of our Website, our users, and our databases and other technology assets, and diagnose or fix technology problems.
- Investigate or prevent a violation of any individual's contractual or other relationship with MDVIP or where MDVIP has a good faith belief that access, preservation or disclosure of such information is reasonably necessary to protect the rights, property or safety of MDVIP, our users or the public or to prevent or respond to any illegal, fraudulent or harmful activity.
- Conduct testing, research, analysis, and product development, including to develop and improve our Website and your experience with the Website, grow our business, develop new products and services, and understand our user base.
- Send marketing communications, including providing you (via alerts, banner ads, postal mail, event registration, email, text message, and other notices) with information about offers, programs and services that MDVIP believes may be of interest to you.
- At the request of law enforcement or governmental agencies or in response to subpoenas, court orders or other legal process, comply with legal requirements, or establish, protect or exercise MDVIP's legal or other rights to defend against a legal claim or as otherwise allowed by law or regulation.
- Evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding.
- Create de-identified and aggregate data that cannot reasonably be linked to you.
4. TARGETED ADVERTISING AND ANALYTICS
We engage others to provide analytics services, serve advertisements, and perform related services across the web and in mobile applications. To do this, MDVIP and these partners may use cookies, pixels, SDKs, and similar technologies to collect information about your use of our services and other websites and mobile apps, including your device identifiers, IP address, web browser and mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked, order information, items added to cart, and conversion information. This information is used to deliver advertising targeted to you on other companies' websites and mobile apps, understand the effectiveness of this advertising, analyze and track data, determine the popularity of certain content, and better understand your activity.
You can opt out of ad targeting through cookies and similar technologies on our Website by following the prompts behind the Your Privacy Choices link in the site footer. Your opt-out choice will be linked to your browser only; therefore, you will need to renew your opt-out choice if you visit our Website from a new device or browser, or if you clear your browser's cookies.
In addition to ad targeting activities that rely on cookies and similar technologies, we may also work with advertising partners to translate other identifiers, such as your email address or phone number, into a unique identifier (called a hashed value) that such partners can then use to show ads that promote MDVIP. We may also disclose your information to advertising partners through other methods to show you ads promoting MDVIP's products and services across the web and in mobile apps. Depending on where you reside, you may opt out of these disclosures by filling out our webform.
The activities described in this section may constitute "targeted advertising," "sharing," or "selling" under certain privacy laws. See the Additional Information for Certain U.S. States section below for details.

5. HOW WE DISCLOSE INFORMATION
We disclose information about you as described in the Targeted Advertising and Analytics section above and in the following scenarios:
- With service providers that we believe need the information to perform a technology, business, or other professional function for us, such as providers who help us operate the Website, assist with MDVIP's marketing, conduct business on our behalf or help us complete a service you requested, such as processing your credit card payment.
- With your consent or when you direct us to disclose your personal information, including to physicians who are affiliated with MDVIP.
- With entities in our corporate family, for purposes consistent with this Privacy Notice, to carry out our business activities, and to the extent permitted by law.
- When a corporate event occurs, we reserve the right to transfer to another entity or its affiliates or service providers some or all information about you in connection with, or during negotiations of, any merger, acquisition, sale of assets or any line of business, change in ownership control, or financing transaction.
- For legal purposes, when required to do so by law, in response to court orders, law enforcement, or legal process, including for national security purposes, to comply with its legal obligations or to investigate or prevent suspected illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person, or to establish, protect, or exercise, our legal rights.
We may also disclose aggregated or de-identified information that cannot reasonably be used to identify you. If we do so, we will maintain and use this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.
